43. Fees

    A.  Claimant’s Fees
      Administrative Fee. The party filing a Demand for Arbitration or a corrected Demand for Arbitration to reinstate a case shall pay an administrative fee in the amount of $225 to the FORUM. The administrative fee is due and payable in full at the time of filing. Any party filing an Amended Demand for Arbitration pursuant to Rule 15 more than forty-five (45) days from the date of initiation of the original case shall pay an administrative fee in the amount of $225 to the FORUM.

      The claimant shall be entitled to a refund of $50 of the administrative fee if (a) the respondent filed a Statement of Response within forty-five (45) days of the initiating letter and (b) the FORUM received notice of the settlement of all claims in dispute within 30 days from the date the respondent’s Statement of Response was received by the FORUM.

      Emergent/Expedited Relief. Any application for Emergent/Expedited relief shall include an application fee of $100, in addition to the $225 administrative fee.

    B.  Respondent’s Fees
      Administrative Fee. An administrative fee of $225is payable by the respondent unless all claims in dispute are resolved and the FORUM receives a notice of the resolution within forty-five (45) days from the date of the initiating letter.

      The respondent shall be entitled to a refund of $50 of the administrative fee if (a) the respondent filed a Statement of Response within forty-five (45) days of the initiating letter, and (b) the FORUM received notice of the settlement of all claims in dispute within 30 days from the date the Statement of Response was received by the FORUM, and (3) the respondent has paid the administrative fee.

    C.  Emergent/Expedited Relief.
      If a Demand for Arbitration seeks Emergent/Expedited relief, then the respondent’s administrative fee is due immediately.

    D.  Pre-Hearing Dismissal Application Fee.
      Any application for Pre-Hearing Dismissal shall include an application fee of $100.

      If the Application for Pre-Hearing Dismissal is not made within forty-five (45) days of the date of the Initiating Letter, the respondent must also submit the $225 administrative fee.

      If the Application for Pre-Hearing Dismissal results in an Order dismissing all claims presented, then the successful respondent shall be entitled to a refund of the $100 dismissal application fee.

    E.  Fee For Three-DRP Panel.
      An additional $500 shall be paid when three (3) DRPs are appointed in accordance with Rule 16. The fee shall be paid by the party requesting the three (3) DRPs.

    F.  Fees for Appeal.
      A party requesting an Appeal shall pay an administrative fee of $630.

    G.  Fees for Copies.
      Parties requesting copies of documents from the FORUM shall pay such fee as set by the FORUM in its sole discretion.

    H.  Abeyance Fee.
      If a case is placed in abeyance by consent of all parties, the FORUM shall keep the case in abeyance without charge for up to 365 calendar days.

      If the parties consent to keeping a case in abeyance for any additional time, the claimant shall pay to the FORUM an administrative fee of $100 for each additional period of up to 365 calendar days. If the claimant fails to pay the required fee, the FORUM shall administratively dismiss the case on notice to all parties.
