New Jersey No-Fault Arbitration Process
A party files a Demand for Arbitration with the FORUM in accordance with the FORUM’s New Jersey No-Fault PIP Arbitration Rules. This party is known as the Claimant.
The FORUM notifies all parties of the arbitration with an initiation letter.
The Respondent has 45 days to file with the FORUM a Statement of Response.
The FORUM assigns a Dispute Resolution Professional (DRP) from its panel to hear the case. Parties will be notified of the appointment and may issue reasonable challenges within 20 days.
The FORUM sets a hearing date and location. Parties receive notification of the date, time and location at least 30 days in advance.
Parties must notify each other and the FORUM of any additional information or expert witnesses at least 20 days prior to the hearing. Late submissions may be disallowed.
Parties attend the oral hearing before the DRP and present claims, defenses, exhibits, proof and witnesses. If the DRP requests further information from a party, that party has 20 days following the hearing to provide it.
After the hearing closes, the DRP reviews the case and issues a written decision.
